Five things to think about when separating from a partner

Separating from a partner especially where children are involved can be difficult but it does not have to be impossible. Given that it is often hard to see the wood for the trees, here are 5 things to think about following separation:-

1.    It can often be hard to tell children that your relationship as husband and wife has come to an end but this will not affect your role as mum and dad. It can help to speak to children together or agree a way in which you are both going to approach it.

2.    Do not fight over the dining room furniture or the TV, try to agree this together as a Judge will not attend your property and saw the couch in half.

3.    Sorting finances out is often difficult as a couple and can be messy when you come to try and untangle them i.e. rearranging direct debits, closing joint accounts and becoming financially independent but unfortunately these are a necessity to be dealt with as soon as possible post separation. Horror stories of raided joint accounts unfortunately often become a reality so be proactive.

4.     If you do feel ready to issue proceedings for divorce, unfortunately it is still a fault based system and the petitioner must establish one of 5 facts for a divorce. The issue fee for the petition is currently £550. Divorce proceedings are beneficial in that they open the door to children and finances.

5.     An option available to couples is collaborative law.
