Professional Negligence
On a day-to-day basis, companies and businesses place a great deal of trust in professional advisors. The reality is that those professionals can make mistakes and fail to perform to the requisite standard. Even the smallest mistake or bad advice can cause the most devastating loss, which in turn can give rise to a claim for professional negligence. If loss has been suffered as a result of negligence, compensation and other remedies can be sought.
Businesses and individuals are becoming more and more reliant on their professional advisors to guide them and represent their interests. Lawyers, accountants, property professionals and other specialists working in surveying, architecture, insurance or financial services for example have a responsibility to their clients to undertake such work with reasonable care and skill.
If a problem arises, the professional will usually have the benefit of indemnity insurance so that, assuming liability is established, the claimant will be able to recover some or all of their loss and the cost of bringing the claim.
Our Litigation team has the experience and expertise to understand what is needed to win professional negligence claims. We are familiar with the tactics used by those defending professional negligence claims. We know when to settle (either by mediation or other ADR) and when to litigate and we make sure that the needs of our client are put first. From the outset of a claim, our dispute resolution solicitors will provide clear guidance regarding likely costs and litigation funding options.
We have experience of high value and complex claims on behalf of claimants (often through referrals from other professionals) for negligence, breach of contract and misrepresentation; including against the following professions:
- Legal
- Accountants
- Financial Advisors and Managers
- Architects and Surveyors
- Construction and Engineering Professionals
- Insurance Brokers
