Competition for positions is fierce. Lancashire Life July 2010.
1) Whilst some people might be tempted to embellish their CV in order to make themselves stand out from the crowd, this might land them in hot water at a later date.
If an employerfinds out that you have lied on your CVor application form they may be able to dismiss you or even sue you for misrepresentation. This could happen even years down the line.
2) As a result of the new Equality Act from October 2010 employers will no longer be able to generally ask you about your health during the recruitment process. Any medical questions should now focus upon aspects of the role which are essential. Any probing questions into someone's health may be unlawful. This could also give an applicant a stronger case to argue they have suffered discrimination if they are turned down for the role.
3) Refusing to employ someone because of their race, gender, disability, sexuality, age, or religious beliefs is unlawful. Language such as young, dynamic, or mature could fall foul of anti-discrimination laws. Employers that use this language expose themselves to potential claims from applicants.
John Hassells, Head of the Employment Department and Partner at KBL says: ‘The tough economic climate has resulted in competition for positions being fierce. Nevertheless it is important that applicants and businesses ensure that they are adhering to the relevant legal requirements in order to avoid exposing themselves to unnecessary litigation.’
