Removal out of the Jurisdiction

This is a complex area particularly now that many people are looking to relocate abroad.

Generally no one may remove a child out of the UK without either the written consent of every person who has parental responsibility or leave of the court so long as a Residence Order is in force.

The person with a Residence Order or a Parental Responsibility Agreement may take the child out of the country for a period of up to one month (for instance on holiday) without leave of the court.
