Despite the best intentions, sometimes products do not meet requirements.

Manufacturing can be a complex process whether producing something as simple as a paperclip or something as sophisticated as a high powered sports car. Disputes can arise with:

  • Delay in supplying the products.
  • Defective quality or problems with sale by sample.
  • Liability in negligence for defects.
  • Payment for products supplied, including retention of title.

Problems may arise with machinery purchased to produce the items. Very often, the machines bought require a large capital outlay and their failure to perform can have a significant effect on the profitability of the business. If a machine fails to work and a dispute arises, it is important to resolve the issue quickly so as to minimise losses caused by downtime.
